Mechanics Lien & Stop Notice Timeline
The Prerequisites:
Properly licensed at all times
Preliminary notice served
1- When the Owner Records a Notice of Completion Or a Notice of Cessation
For General Contractors
• Owner files Notice of Completion or Notice of Cessation
• You have 60 days to Record the Mechanic Lien
• Before you Record the Lien, you must provide NOTICE to the Owner.
[Any Mechanic Lien is invalid without it!!!]
• Record the Mechanic Lien in the Recorders or Assessor’s Office
of the County or Town where the project is located.
• File Your Lawsuit within 90 days of recording the Mechanics Lien
• Record a Lis Pendens in the Recorders or Assessor’s Office
For Subcontractors & Suppliers
The same sequence of events needs to occur EXCEPT you have only 30 Days to Record the Lien following Notice of Completion or Notice of Cessation.
2- When Owner Accepts Project or Takes Beneficial Occupancy Without Filing a
Notice of Completion or Cessation
For General, Subcontractors & Suppliers
• Owner files Notice of Completion or Notice of Cessation
• You have 90 days to Record the Mechanic Lien
• Before you Record the Lien, you must provide NOTICE to
the Owner.
• Record the Mechanic Lien in the Recorders or Assessor’s Office
of the County or Town where the project is located.
• File Your Lawsuit within 90 days of recording the Mechanics Lien
• Record a Lis Pendens in the Recorders or Assessor’s Office
3- When the Owner Does NOT File Notice of Completion or Cessation,
Does Not Take Possession and Work Stops for 60 days
For General, Subcontractors & Suppliers
• Work stops for a continuous 60 days =’s completion
• All contractors have 90 days to Record Lien from end of 60 day cessation
(150 day total- 60 + 90)
• Before you Record the Lien, you must provide NOTICE to the Owner.
• Record the Mechanic Lien in the Recorders or Assessor’s Office
of the County or Town where the project is located.
• File Your Lawsuit within 90 days of recording the Mechanics Lien
• Record a Lis Pendens in the Recorders or Assessor’s Office
